Terms & Conditions of Use

These Terms and Conditions govern access to and use of the website www.servitrackgps.com, the web tracking platform, and associated mobile applications (hereinafter "The Platforms"), operated by Corporación Servitrack, C.A. ("Servitrack GPS").

Downloading, installing, browsing, or using The Platforms constitutes full and unconditional acceptance of these Terms and Conditions. If you do not agree, you must refrain from using the service.

1. Service Description

Servitrack GPS provides satellite tracking and vehicle location services using GPS/GSM technology, supplemented by:

• Access to a 100% self-managed web platform and mobile applications for iOS and Android.
• 24/7/365 monitoring and support from our Monitoring Center.
• Telemetry tools: speed alerts, motion/towing notifications, route/geofence boundaries, service reminders, and driver behavior scoring.
• Remote control features (engine cut-off, electronic door lock/unlock) subject to technical vehicle compatibility and required installation.
• Logistical support in coordination with State Security Agencies for the search and recovery of stolen vehicles.

2. Registration, Accounts, and Credential Responsibility

1. To access The Platforms, the user will receive access credentials (username and password).
2. The user is solely responsible for maintaining the confidentiality of their credentials and for all activities performed under their account.
3. The user agrees to notify Servitrack GPS immediately of any unauthorized use of their account.

3. Use of Remote Commands (Engine Cut-off and Electronic Door Locks)

The use of remote control features from the mobile application or web platform (such as engine immobilization/cut-off or door unlocking) is performed under the user's sole responsibility.

Servitrack GPS shall not be held liable for material, personal, or third-party damages resulting from imprudent or unauthorized execution of engine cut-off or remote door unlocking commands from the user's account.

4. Theft or Emergency Protocol

In the event of theft or robbery of the monitored vehicle, the user must follow this procedure:

1. Immediate Notification: Contact the Servitrack GPS Monitoring Center immediately at +58 (212) 821-7400 Option 3 (Theft) or via WhatsApp at +58 (414) 127-3892.
2. Data Provision: Provide subscriber name, immediate contact telephone number, and vehicle license plate number.
3. Formal Police Report: The user has an imperative obligation to file a formal police report with the Scientific, Penal, and Criminal Investigation Corps (CICPC) or nearest competent police agency, explicitly declaring that the vehicle is equipped with a satellite GPS tracking device.
4. Coordination: Servitrack GPS will track the vehicle and deliver real-time location data to competent police authorities so they may perform the legal recovery of the vehicle. Servitrack GPS does not replace police authority nor assume custody of recovered assets.

5. Service Limitations and Telecommunications Networks

Continuous operation of the tracking service relies on technical infrastructure and third-party networks:

• GSM/GPS Network Coverage: Transmitting coordinates and alerts requires cellular network coverage and GPS satellite signals. Servitrack GPS does not guarantee real-time transmission in underground locations, tunnels, armored garages, or geographic areas lacking cellular coverage.
• Signal Interference & Sabotage: Although our devices feature internal battery backups to mitigate accidental or intentional main vehicle battery disconnection, Servitrack GPS is not liable for service interruptions caused by signal jammers, unauthorized physical device tampering, or force majeure events.

6. Owner / User Obligations and Declaration

The client declares under oath that they are the legitimate owner of the registered vehicle or possess corresponding legal authorization for the installation and monitoring of the GPS tracking device.

Using the service for unlawful purposes, unauthorized surveillance, or activities contrary to the laws of the Bolivarian Republic of Venezuela is strictly prohibited.

7. Intellectual Property

All content on The Platforms—including software, UI design, trademarks, logos, integrated maps, graphics, and source code—is the exclusive property of Corporación Servitrack, C.A. or its licensors and is protected by national and international intellectual property laws. Unauthorized reproduction, modification, or reverse engineering of the app or web platform is prohibited.

8. Service Suspension

Servitrack GPS reserves the right to temporarily or permanently suspend access to platforms in cases of:

• Non-compliance or delinquency in subscription or maintenance fee payments.
• Fraudulent, improper, or violating use of these Terms and Conditions.
• Scheduled server maintenance or platform update operations.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the current laws of the Bolivarian Republic of Venezuela. Any legal dispute or controversy arising from their interpretation or execution shall be submitted to the competent courts of Miranda State, Venezuela.
